My query is related to divorce matter: Background: X. Marriage: Me and my wife are Indian citizens, got married on August-9-2XX8 in New Delhi, under Hindu Marriage Act. 2. I have been living in Stamford, CT, since January 2XXX. My wife moved here on September-XX-2XX8. X. We are filing for mutual consent, no fault, divorce in Stamford Connecticut. Want to file within next X week. We qualify for and will file the simple, non-adversial, mutual consent divorce in Connecticut - processing time of XX days or less. Questions: X. Suppose we file on July-2X-2XX9 in Stamford, CT, and (for sake of making the point), say the divorce decree is issued August-XX-2XX9. What is the process to get divorce recognized in India (Hindu Marriage Act) ? Will court accept the divorce even though it is a. No Fault, b. Been less than X year since we married. c. No X year separation has been done. Or will the divorce decree not hold due to any of the above reasons? 2. The divorce papers that will be signed indicate that no spouse will ask for support, alimony, etc. Once decree is issued, will same thing hold in Indian court? Or can my spouse change things - claim alimony/support; or say it was not mutual consent (she was pressurized due to new country, etc. etc.)? I am asking so I can safeguard and avoid future complications. X. I am told once divorce decree is issued, we should get an Apositlle and use that in Indian court. Is that a good idea? Or is filing fresh in Indian court better? 4. My in-laws are visiting and are at my apartment with my wife also. I want to move out immediately. Is there any drawback to that? Will that hurt my case in any way?
